Terms and Conditions

Last updated: 20 October 2026

§ 1 Scope and contracting party

(1) These terms and conditions apply to all orders you place in our online shop at hustleandpain.com.

(2) Your contracting party is HUSTLE&PAIN, owner Alexander Klenner, Johannesstr. 72, 70176 Stuttgart, Germany, email: info@hustleandpain.com (hereinafter “we”).

(3) A consumer is any natural person who enters into a contract for purposes that are predominantly outside their trade, business or profession (Section 13 of the German Civil Code, BGB). A business is anyone who, when concluding the contract, acts in the exercise of their trade, business or profession (Section 14 BGB).

(4) Deviating terms of businesses apply only if we expressly agree to them.

(5) How we process your data is explained in our privacy policy.

§ 2 Conclusion of the contract

(1) The presentation of products in our shop is not a binding offer but an invitation to you to place an order.

(2) How to order: you choose a product and your size and add it to the cart. In the cart, you click “Checkout”. At checkout, you enter your email address, your delivery address and your payment method. Before you submit, you see all details, the products and the total price once more. By clicking “Pay now”, you make a binding offer to buy the products in your cart. With Apple Pay, Google Pay, PayPal or Shop Pay, you make it by confirming the payment in the provider’s window.

(3) You can correct input errors at any time until you click the order button: directly in the input fields, via the cart or with your browser’s back function.

(4) Directly after your order, you receive an order confirmation by email. With this order confirmation, we accept your offer. The contract is concluded at that moment.

(5) German and English are available for concluding the contract.

(6) We store the contract text. After the contract has been concluded, you can no longer access it on our website. We send you your order details, these terms and conditions and the instructions on withdrawal with the order confirmation by email. If you have a customer account, you can also see your orders there.

§ 3 Customer account

You can order without a customer account. If you choose to create a customer account, you can view your orders there. You can have your customer account deleted at any time; a short email to info@hustleandpain.com is enough.

§ 4 Prices and shipping costs

(1) All prices are final prices and include statutory VAT.

(2) We only deliver to delivery addresses in Germany. You can also order if your place of residence or billing address is in another country of the European Union. Shipping is free. Details are in our shipping policy.

§ 5 Payment

(1) You can pay by credit card, PayPal, Klarna (depending on what is offered at checkout, also by invoice or in instalments), Apple Pay, Google Pay and Shop Pay.

(2) The purchase price is due when the contract is concluded, unless something else is stated for the chosen payment method.

(3) If you pay via PayPal or Klarna, the terms of that payment service apply between you and the payment service. With invoice or instalment purchase via Klarna, you pay Klarna.

§ 6 Delivery and transfer of risk

(1) We deliver to the address you provide in Germany. The delivery time is 2 to 4 working days (Monday to Friday, excluding public holidays) from conclusion of the contract. If a different delivery time or a delivery date is stated for an item or size, that information applies. A delivery date is the latest day of delivery.

(2) If you order items with different delivery times, we deliver in several parcels. This does not cost you any additional shipping.

(3) If you are a consumer, the risk of accidental loss and accidental deterioration of the goods only passes to you when the goods are handed over to you. If you are a business, it passes when the goods are handed over to the shipping company.

§ 7 Retention of title

The goods remain our property until they have been paid for in full.

§ 8 Right of withdrawal

As a consumer, you have a right of withdrawal of 14 days. All details are in our instructions on withdrawal. You can also declare your withdrawal online: via the “Withdraw from contract” button at the bottom of every page of our shop.

§ 9 Defects

(1) The statutory rules on liability for defects (legal guarantee) apply. The guarantee period is at least two years from delivery.

(2) If goods arrive with obvious transport damage, please complain to the delivery driver straight away if possible and let us know. If you do not, this has no consequences for your statutory rights. It does, however, help us assert our own claims against the shipping company.

§ 10 Liability

(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, for fraudulently concealed defects and where we have given a guarantee.

(2) If we slightly negligently breach an essential contractual obligation, our liability is limited to the foreseeable damage typical for this type of contract. Essential contractual obligations are obligations whose fulfilment makes the contract possible in the first place and on whose fulfilment you may regularly rely.

(3) Otherwise, we are not liable for slight negligence.

(4) These rules also apply to our legal representatives and vicarious agents.

§ 11 Discount codes

Discount codes are only valid during the stated period and for orders in our shop. You can redeem one code per order, unless the code says otherwise. Codes are not paid out in cash and cannot be applied retrospectively to an order that has already been placed. If you withdraw from an order, we refund the amount you actually paid.

§ 12 Dispute resolution

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board. If you have questions or complaints, just write to us at info@hustleandpain.com.

§ 13 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law only applies insofar as it does not deprive you of the protection of mandatory provisions of the state in which you have your habitual residence.

(2) If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is Stuttgart.
